What does the term "national"

mean for persons, whether natural

or legal in Hong Kong? There's no Hong Kong nationality as such!

It's a problem peculiar to separate

customs territories like Hong Kong

or Macau. But if I don't raise it, no

one will.

Peter looks responsible.

Let me propose a deeming provision

applying the Nottebohm 'effective nationality' principle. Persons who are domiciled or who have a real and

effective industrial or commercial

establishment in a customs

territory have the requisite genuine

link.

Peter hits the computer keys and then pauses.

As a Hong Kong proposal in the international arena, I'll be contented

if it would be included as a footnote

since it should constitute as part

of the text of the Agreement.

Peter looks encouraged.

I see! There's no European nationality

as such either!

Peter reads with subdued smile and nods.

That's fine.

EXPATRIATE

I don't know where would it be

inserted.

PETER

As a footnote would be fine, as

it should still constitute part of

the text.

Here's my contribution in the
